1. Definitions

User: Any subject who accesses and uses the Site
Content: Any textual or multimedia element present on the Site, for example, articles, news, advertisements, reviews, images, comments, videos, etc.
Conditions: This contract governs the relationship between the Owners and the Users.

2. Information on the site offer

My Career Canvas provides:
  • training content in the form of blogs and downloadable material to help those who need to define their professional career
  • access to the reserved area where My Career Canvas is delivered
  • presentation of further services offered by My Career Canvas (e.g. personal branding and business creation consultancy).

3. Account

  • In order to carry out most activities on My Career Canvas, including purchasing and accessing My Career Canvas, it is necessary to have an account. When you set up and maintain your account, you must provide accurate and complete information, including a valid email address, and keep it up to date at all times.
  • You are fully responsible for your account and everything that happens on your account, including any damage, whether to My Career Canvas or to a third party, caused by the use of your account by a third party. This means that you must use extreme caution when handling your password.
  • You may not transfer your account to a third party or use a third party's account. You may not share your account access credentials with third parties. If you learn that other people are using your account without your permission or if you suspect that a security breach has occurred, you must notify us immediately.
  • Users must be 18 years of age or older to create an account on My Career Canvas and use the Services. You may close your account at any time. Please note that by closing your My Career Canvas account, you will no longer be able to access the course you have signed up for, even if you have purchased it.

4. Content subscription and access

The Owners grant the user a limited, non-exclusive and non-transferable licence to access and display the content for which he has paid all required fees solely for personal and non-commercial purposes. All other uses are expressly prohibited.
Reproduction, redistribution, transmission, assignment, sale, broadcasting, rental, sharing, lending, modification, adaptation, creation of derivative works, sublicensing or other transfer or use of any content is prohibited unless the Owner provides the user with an express authorisation in writing signed by an authorised representative of My Career Canvas.

5. Paid services

  • The User agrees to pay the sums due for the services he purchases and authorises the Owners to debit these sums from the chosen means of payment.
  • The Owners reserve the right to suspend the service until the amount due is received.
  • The Owners may offer gift and promotional codes, which may be used to purchase services. Such codes have an expiry date and cannot be redeemed for cash. The user may request a refund from the Owners within 14 days of purchase.
  • The Owners reserve the right to apply a refund credit or a refund to the original payment method, at its discretion, based on the capabilities of its payment service providers, the platform on which the user purchased the content, and other factors.
  • No refund is due if this is requested after starting any of the paid services in My Career Canvas.

6. User-submitted content

The User may upload certain Content permitted by the Owners on the Site, provided that it is not unlawful (i.e. obscene, intimidating, defamatory, pornographic, abusive or in any way illegal or violates the privacy, intellectual and/or industrial property rights of the Owners and/or third parties), misleading, or is not in any other way detrimental to the Owners and/or third parties or does not contain viruses, political propaganda, commercial solicitation, mass e-mail or any other form of spamming. In the event of a dispute by a third party, the User assumes full responsibility and agrees to indemnify and hold harmless the Owner against any damage, loss or expense. The User guarantees that the Content is sent to the Site via his/her account by persons of age. For minors, the submission of Content must be screened and authorised by their parents or parental responsibility holders. The User is entirely and exclusively responsible for the use of the Site with regard to the functions of publication, consultation, management of the Contents and contact between Users and is therefore the sole guarantor and responsible for the correctness, completeness and lawfulness of the Contents and his own behaviour.

It is forbidden to use an e-mail address that is not the User's, to use the personal data and credentials of another User in order to appropriate the User's identity, or in any other way to falsely declare the origin of the Content. The Owners is not able to ensure timely control over the Content received and reserves the right at all times to delete, move, modify those that, in its discretion, appear illicit, abusive, defamatory, obscene or harmful to copyright and trademarks or in any case unacceptable. The Users grant the Owners a non-exclusive right of use over the Content sent, without geographical area limitations. The Owners may therefore, directly or through trusted third parties, use, modify, copy, transmit, extract, publish, distribute, publicly perform, disseminate, create derivative works from, host, index, store, annotate, encode, modify and adapt (including without limitation the right to adapt for transmission by any means of communication) in any form, any Content (including images, messages, including audio and video) that may be sent by the User, even through third parties.

Submitted Content shall not be returned and the Owners shall not be liable to Users for the loss, modification or destruction of the Content transmitted. The following is expressly prohibited, unless expressly authorised by the Owners: i) the use of automatic systems for uploading announcements, except for those expressly authorised, ii) the serial publication and/or management of announcements on behalf of third parties by any means or methods, iii) reselling the Owners' services to third parties.

7. Intellectual and Industrial Property Rights

The Owners declare to be the owner and/or licensee of all intellectual property rights relating to and/or pertaining to the Site and/or the Contents available on the Site. Therefore, all trademarks, whether figurative or nominative and all other signs, trade names, service marks, trade names, illustrations, images, logos, and contents related to the Site are and remain the property of the Owners or their licensors and are protected by the applicable trademark laws and relevant international treaties.
Specifically, My Career Canvas® is designed by Michela Luoni and Selvaggia Fagioli, and registered as Registered Community Design No 008672893-0001. Licence for use and legal information: careercanvas.me/Licence-Canvas.
The Conditions do not grant the User any licence to use the Site and/or the individual contents and/or materials available therein, unless otherwise regulated.Any reproduction in any form of the explanatory texts and Contents of the Site, if not authorised, shall be considered an infringement of the Owners' intellectual and industrial property rights.

8. Warranty Exclusion

The Site is provided on an "as is" and "as available" basis and the Owners make no express or implied warranties in relation thereto, nor does it make any warranty that the Site will meet the needs of Users or that it will be uninterrupted or error-free or that it will be free of viruses or bugs. The Owners shall endeavour to ensure that the Site is available 24 hours a day without interruption, but shall in no way be held liable if, for any reason, it is not accessible and/or operational at any time or for any period. Access to the Site may be suspended temporarily and without notice in the event of system failure, maintenance, repairs or for reasons wholly beyond the Owners' control or for events of force majeure.

9.  Limitation of Liability

The Owners shall not be liable to the User, except in the case of wilful misconduct or gross negligence, for disservices or malfunctions related to the use of the Internet outside of its control or that of its suppliers. The Owners shall also not be liable for any damages, losses and costs incurred by the User as a result of the non-performance of the contract for reasons not attributable to him. The Owners shall not be liable for any fraudulent and unlawful use that may be made of credit cards and other means of payment by third parties. The Owners shall not be liable for: a. any loss of business opportunity and any other loss, even indirect, that may be suffered by the User that are not a direct consequence of the breach of contract by the Owners b. incorrect or unsuitable use of the Site by Users or third parties. In no case may the Owners be held liable for more than double the amount paid by the User.

10. Force majeure

The Owners shall not be held liable for non-fulfilment or delayed fulfilment of its obligations due to circumstances beyond the Owners' reasonable control caused by events of force majeure or, in any case, by unforeseen and unforeseeable events and, in any case, beyond its control. The performance of the obligations by the Owners shall be deemed suspended for the period during which force majeure events occur. The Owners shall take any action in his power in order to find solutions that enable the proper fulfilment of his obligations despite the persistence of force majeure events.

11. Linking to third-party sites

The Site may contain links to third party sites/applications. The Owners do not exercise any control over them and is therefore in no way responsible for the content of these sites/applications. Some of these links may refer to third party sites/applications that provide services through the Site. In these cases, the general conditions for the use of the site/application and for the use of the service provided by the third parties will apply to the individual services, in respect of which the Owners accept no responsibility.

12. Privacy

The protection and processing of personal data will take place in accordance with the Privacy Policy, which can be found at https://percorso.careercanvas.me/privacy

13. Applicable law and jurisdiction

The Conditions are subject to Italian law. Any dispute relating to the application, execution and interpretation of these Conditions shall be settled by the Court of Milan.
